ICO: Two cited for illegal hunting practice
WARRICK CO., IN - Two Tri-State men are cited for an illegal hunting practice.
Conservation officers say it happened Saturday night in Warrick County.
Officers received a report that people were jacklighting.
Jacklighting is the practice of shining a light from a vehicle to lure animals into being easy targets.
Conservation officers say they watched two suspects, Jason C. Stock and Damon R. Curry, cruise the area on four wheelers, shining lights into the tree line as they went.
Both Stock and Curry were in possession of loaded muzzle loaders that were primed and ready to fire, a release said.
Officials say they also found marijuana.
Their guns and lights were taken.
Stock and Curry were cited and released.

I was told that it was "too much paperwork" to take the vehicles that poachers use.

Pair face drug, hunting citations
WARRICK COUNTY, Ind. — Indiana conservation officers cited two men allegedly caught "jacklighting" in Warrick County.
Jason C. Stock, 32, of Evansville and Damon R. Curry, 33, of Newburgh were cited for possession of a firearm while shining an artificial light from a motorized vehicle and possession of a loaded firearm while operating an off-road vehicle. Curry also was cited for possession of marijuana and possession of drug paraphernalia, according to a news release.
On Saturday evening, conservation officer Gordon Wood received information that "jacklighting" was taking place in the area of Ebe and Lynn roads in the north central part of Warrick County.
It is against Indiana law to shine a light from a motorized vehicle while in possession of a firearm or bow. Jacklighting, as it is commonly called, not only violates the rules of fair chase but also could lead to a "shot in the dark" that could easily damage property or cause injury to people, said conservation officer Mike Kellner.
Wood contacted fellow officers Duane Englert and Mike Lamarr to assist in setting up observation points throughout the area. The officers watched as Stock and Curry cruised on four-wheelers along tree lines and fields shining as they drove along, according to the release.
The vehicles were stopped by the officers when they pulled on Lynn Road. Both Stock and Curry were in possession of muzzleloaders that were ready to fire, according to the release. The firearms and lights were seized along with the marijuana and paraphernalia.
Stock and Curry were cited and released.

So your telling me if these "idiots" would have been smart enough not to have the 209 primer or percussion cap on their muzzleloaders there would not have been a violation?

If you're in possession of a firearm, while spotting deer, you're in violation, as I understand the law. You're allowed to shine deer, but not if there is a gun or bow in the vehicle.'

I was told that it was "too much paperwork" to take the vehicles that poachers use. You wouldn't believe the computer work these guys have to do for every little thing now. Lots of red tape. |

I'd say the CO. knew one of em...normally they'd sieze those too.They went easy on em..Don't do that in our county..you'd be sorry....which is how I like it.. |

I know Officers Wood and Kellner and no they would not give a break to anyone that they knew.. They are both outstanding officers. In fact I think Gordon Wood was CO of the year one year. |

I know two of the mentioned officers pretty well and met with one of the others mentioned briefly while he waited at my truck for my wife and I to come out of the turkey woods. While he was contemplating giving me a ticket for carrying my pregnant wife's shotgun back to the truck for her, he seemed pretty fair.  I do not see any of them giving preferential treatment to anyone. I know that Officer Kellner and Woods are both a great asset to conservation law enforcement for Southern Indiana. |

According to the Hunting Guide you can spotlight from a vehicle while being in possession of gun/bow etc, as long as it isn't loaded. There is another sentence or two in that same paragraph that says you cannot spotlight and be in possession of ANY firearm/bow/crossbow (says nothing about loaded or unloaded). So, one can only assume since the major difference in those two sentences are the words "motor vehicle" that there are 2 sets of regulations depending on your mode of transportation. |

(clip) Spotlighting It is illegal to shine a spotlight, searchlight or other artificial light for the purpose of taking, attempting to take or assisting another person to take a deer, or to shine such a light while in possession of a firearm, bow or crossbow. It also is illegal for a person to deliberately cast a spotlight or other artificial light from a motor vehicle if in possession of a loaded firearm, bow and arrow or crossbow. I know that at least SOME CO's enforce that law as not being in POSSESSION of a firearm or crossbow. I have been stopped, and they have told me such, even though I was NOT in possession of a gun at the time. He saw my CCW permit when I was getting my DL out of my wallet, and specifically asked if I had a handgun in the truck. Now that said... LEO's don't ALWAYS know the laws they are enforcing... so if ticked for that, one COULD make a strong arguement in court that you were innocent, as long as it was not loaded. disclaimer: I am NOT a lawyer, and my advise is worth as much as you paid for it.
