Belly boat question: Are these considered to be boats, or would a person using one be considered to be swimming, and thereby subject to a fine for swimming in undesignated area? parson

The question was answered on HH Ask a CO Forum as well. It depends on how the tube is being used. Are you fishing from the tube and using it as transportation on state waters or are you simply swimming with it? The answer will depend on how it is being used and how the CO you might be dealing with interprets the law. Can you be cited and charged in court for floating on a tube/fishing from a tube on state waters without being in possession of a PFD?.....absolutely. I know an officer that issued a number of tickets for that offense to a group of tubers on White River. The deputy prosecutor filed the case and the judge found them guilty and assessed fines and court costs. I know of other instances where warnings have been issued. It will come down to how each individual officer interrets the law and how they decide to enforce it. My best advice is to bring one along...you never know when you might need it to save your life!
