A gold prospecting friend of mine said it is legal for her to pan for gold in a year-round stream that courses through private property without permission from the landowner, as long as she is wading and not on the dry land itself. She said this was one of the first things she learned from her involvement with GPAA (Gold Prospectors Association of America), Southern Indiana Chapter. Is she correct?

She's been watching too much 'Gold Fever' on the Outdoor Channel! (Just kidding! ) No. She MUST have the landowner's permission to be standing on the bottom of a 'stream' that meanders through private property, regardless if she is waterfowl hunting, deer hunting, gold prospecting, etc. The only exemption would be if she was wading a navagible waterway, like the White or Wabash Rivers. Even then, she would have to concern herself with the mineral rights of that particular property that would apply regardless of the navagibility of the waterway.
