after reading another thread I got to wondering, what exactly is the definition of swimming in an un-authorized area? What about when I have my kids at the lake tubing and such? If all are wearing pfd's does this cover us from being ticketed? Same on the rivers, at what point are you not wading but swimming etc.?

This refers to DNR properties (reservoirs, state parks, state rec areas, etc.) 312 IAC 8-2-9 Swimming in an unauthorized area A person must swim or allow a child or other person to swim, other than at the following locations: 1. at a designated swimming beach or pool during designated hours. 2. from a watercraft between sunrise and sunset in an embayment on a reservoir property established under 312 IAC 5-10 as an idle zone, but is not in a causeway or within 100 feet of a designated launching ramp or other public use facility.
So, if you are tubing (not acting like you are tubing to skirt the law), you are legal. PFD or not, it is restricted except in the exceptions posted above. Same as on rivers inside DNR properties. Wading is also prohibited, at least at Turkey Run SP (Sugar Creek inside the park) here in Parke County. Although the majority of the swimming in unauthorized area tickets I issue are for the folks jumping off of the rock cliffs and bluffs into Sugar Creek inside TRSP, we do ticket swimmers and waders depending on the situation.
