Legally, I can not answer, but practically burning it will most likely not fix the situation, there will still be hang-ups under water.
If you do not have a tractor and chain to pull some of the logs out, ask around and see if there is any locals that burn fire wood, most would clean it out for the wood.
Removal of the logs below the water surface is the only way to clear out an area to stop the next flow from piling up. On that same note, those logs provide shelter for fish, a crossing for land animals, and a fishing perch for birds. Most creeks will pile up for several years and the release after some of the bottom logs have rotten and the pile will move on with the next heavy rain.
If it is not causing major problems, leaving it may be the best answer.
