I'm going to be doing some night hunting for coyote here in a week or so. I've read the regs about the continuous burning light and this seems to be one of those "gray" areas so I'm seeking some clarification.
Issue 1 - At what point afield is someone "hunting", meaning at what point must the continuous burning light be turned on? Is this from the moment I leave my vehicle till the moment I return? Is this from the moment I get to my calling location and load my firearm? My guess is most people who can walk to their calling location under cover of night would leave their vehicle, walk to their calling spot being as silent and dark as possible, turn on their light, load their weapon and start their calling sequence. In that scenario would the person be in violation since they did not have the light on while walking to their stand location even though their firearm was unloaded?
Issue 2 - I plan on hunting with a partner at night, and like every hunting show/video in which a night hunt was performed the "team" gets set up, one person shines the spot light and scans for glowing eyes as the other person is on the firearm in anticipation for a shot. In this scenario is the person on the firearm in violation because they did not have a light in their possession that was turned on?
Issue 3 - Under the wording of the rule as it exists in regards to the continuous burning light, and depending on how you answer my scenario in Issue 1, do all persons involved in the hunt have to have their own individual light on at all times even if they are together and not separated by more than a few steps at all times or would one person's light satisfy the law?
Sorry to be so detailed, but like I said this is just one more law that seems to be open to a LOT of interpretation by each individual ICO. I want to be sure I'm doing it the right way......
