IC 14-22-6-1 Taking of wild animals governed by laws and rules Sec. 1. A person may not take, chase, or possess a wild animal, except as provided by: (1) a statute; or (2) a rule adopted under IC 4-22-2 to implement this article. With chase being defined as: IC 14-8-2-39 "Chase" Sec. 39. "Chase", for purposes of IC 14-22, means following wildlife without the intent to take.
I realize that officer discretion may play a role, but I am also aware that CO's MUST enforce the law even if they do not agree with it. Does this mean that an individual could be ticketed for the following:
A. Helping an individual carry a deer/game animal out without a license. If the answer is yes, would an individual be ticketed for wanton waste because they were not able to find someone help them carry a deer out who had a license? Would you encourage individuals to avoid helping someone because of this law? B. Tracking a DEAD deer/wildlife without a license C. Tracking/following deer/wildlife on public ground without a license for scouting/pictures/observation D. Assisting a handicapped hunter without a license
Can I use this law to call a CO to have people such as birdwatchers/nature observers removed/ticketed from public land, or guys that are scouting for the early season for game without a license?

I will start this off by stating that every situation is different.
A. I do not see where someone would receive a citation for helping drag out a deer unless the officer had reason to believe that the person assisted in the actual 'taking' of the deer. To harvest a deer and leave it in the woods would be considered wanton waste. I see no issue with having someone assist you in removing the animal if you are unable to complete the task on your own.
B. I do not see any issue with this unless the officer has reason to believe that the person was more invovled than just the tracking.
C. No. Scouting, pictures, and observing is completed without the intent to take.
D. Same situation and answer as A and B
A license is NOT required for scouting, bird watching, or nature observing.
