What you posted in response to Woody's question, you're saying only those five rounds are legal...which we know is not the case, and the pistol cartridges are now illegal...which they arent

Centerfire Rifles

Rifles chambered for cartridges that fire a bullet of .357-inch diameter or larger, have a minimum case length of 1.16 inches, and have a maximum case length of 1.8 inches are legal to use only during the deer firearms, youth, reduction zones (in zones where local ordinances allow the use of a firearm), and special antlerless seasons. These rifle cartridges can be used on public and private land.

Some cartridges legal for deer hunting include the .357 Magnum, .38-.40 Winchester, .41 Magnum, .41 Special, .44 Magnum, .44 Special, .44-.40 Winchester, .45 Colt, .454 Casull, .458 SOCOM, .475 Linebaugh, .480 Ruger, .50 Action Express, .500 S&W, .460 Smith & Wesson, .450 Bushmaster, and .50 Beowulf. Full metal jacketed bullets are illegal.

New Legal Rifles

A new state law allows rifle cartridges that meet the following requirements to be used for deer hunting only on private land during the firearms, youth, reduction zone (in zones where local ordinances allow the use of a firearm), seasons:

The rifle must have a barrel length of at least 16 inches
The cartridge must have a case length of at least 1.16 inches.
The cartridge must fire a bullet with a diameter that is .243 inches (same as 6mm) or .308 inches (same as 7.62 mm).
Bullets with a diameter smaller than .243 inches (same as 6mm), larger than .308 inches (same as 7.62 mm) or in between .243 and .308 are not legal.
A hunter may not possess more than 10 cartridges for each of these rifles while hunting deer.
Full metal jacketed bullets are illegal.
Handguns

Legal handguns can be used to hunt deer during the firearms, reduction zone (in zones where local ordinances allow the use of a firearm), and special antlerless seasons.

Handguns, other than muzzleloading handguns, must have a barrel at least 4 inches long and mustfire a bullet of .243-inch diameter or larger. The handgun cartridge case, without the bullet, must be at least 1.16 inches long. There is no maximum cartridge length for those used in handguns. Full metal-jacketed bullets are not permitted. The handgun must not be a rifle that has a barrel less than 18 inches. (A rifle with a barrel less than 18 inches is not considered a handgun.)

Handguns are not permitted for hunting on any military areas.

Some handgun cartridges that are legal for deer hunting include .357 Magnum, .41 Magnum, .44 Magnum, .44 Special, .45 Colt, .45 Long Colt, .45 Winchester Magnum, .35 Remington and .357 Herrett.

A new state law also legalizes a handgun that fires the 10mm Auto and 40 Smith & Wesson cartridge.

I will begin by stating that the article you are quoting above is a publication of someone's interpretation of what the statute says not exactly the wording of the statute. While you are accurate in quoting the article, the article is inaccurate as to what the statute says. The statute states "this section" and NOT these cartridges.


I will attempt to clarify exactly what the statute says. However, in contradiction to your post, I did not make any statements as to these being the only rifles legal to use or any statements as to pistols being illegal. I have posted my responses below. I have read over these several times and cannot come close to pulling those two statements you assume I made.
In addition, I have posted the actual statute that pertains to hunting deer with a rifle below. In order to accurately read a statute a person must understand how they are set up. Each section is read independent from other sections and each subsection under a particular section is read independent of each subsection under that section. If a list of sections are combined with an “and”, the person must meet or abide by all of those sections. If a list of sections are separated with an “or”, the person must meet or abide by only one of those sections. If a list of subsections under a section are combined with an “and”, the person must meet or abide by all of those subsections. If a list of subsections under a particular sections are separated with an “or”, the person must meet or abide by only one of those sections. If each section and subsection ends with a period (.) that section or subsection is read independent of the other section or subsection.


Below is the most simplistic method to read the statute.
• Section 8 covers deer hunting with a rifle during the deer firearms season. (NOTE: it governs deer hunting with “a rifle”. It is NOT limited to only the rifle calibers listed in this statute.)
• Section 8(a) applies to a hunting season beginning after June 30, 2016, and ending before January 1, 2020.
• Section 8 subsection (b)(1) states a hunter may use a rifle during the firearms season to hunt deer subject to the use of a rifle is permitted only on privately owned land.
• Section 8 subsection (b)(2) states a hunter may use a rifle during the firearms season to hunt deer subject to the rifle must have a barrel length of at least sixteen (16) inches.
• Section 8 subsection (b)(3) states a hunter may use a rifle during the firearms season to hunt deer subject to the rifle must be chambered for a .243, .30-30, .300, .30-06, OR .308.
• Section 8 Subsection (b)(4) states a hunter may not possess more than ten (10) cartridges for the rifle while hunting deer under this section. (“this section” is Section 8 which covers deer hunting with a rifle during the deer firearms season. NOTE it does not say “the calibers described in this section”.)
• Section 8 Subsection (b)(5) states the rifle must meet any other requirements established by the department. (This is the section that allowed the previously allowed rifles to stay within the guidelines of the statute. The previously allowed rifles “meet other requirements established by the department”)
• Section 8 Subsection (c) states the use of a full metal jacketed bullet to hunt deer is unlawful.

If an individual is hunting deer with a rifle during the deer firearms season, the individual must abide by the statute listed below. The issue is that when the legislation came out last year, everyone focused on the calibers and seemed to ignore the other 4 requirements stated under subsection b.

The hunter would be limited to possessing no more than ten (10) cartridges that can be used in the rifle. This would not be considered a "gray area". Our officers have discretion in when they issue citations, arrest, or warnings. I am informing you based on what the statute says. If a hunter is within the statute, the officer will not be put in a position to determine which avenue will result in the hunter's future behavior being in compliance with the statute. An enforcement action is not only to hold the individual accountable for violating the statute but also to ensure the individual is deterred from committing violations in the future.


IC 14-22-2-8 Deer hunting; permitted firearms; required report
Sec. 8. (a) This section applies to a hunting season beginning after June 30, 2016, and ending before January 1, 2020.
(b) A hunter may use a rifle during the firearms season to hunt deer subject to the following:
(1) The use of a rifle is permitted only on privately owned land.
(2) The rifle must have a barrel length of at least sixteen (16) inches.
(3) The rifle must be chambered for one (1) of the following cartridges:
(A) .243.
(B) .30-30.
(C) .300.
(D) .30-06.
(E) .308.
(4) A hunter may not possess more than ten (10) cartridges for the rifle while hunting deer under this section.
(5) The rifle must meet any other requirements established by the department.
(c) The use of a full metal jacketed bullet to hunt deer is unlawful.
(d) The department shall report on the impact of the use of rifles to hunt deer under this section to the governor and, in an electronic format under IC 5-14-6, the general assembly before February 15, 2020.
(e) This section expires June 30, 2020.
