As a person who is licensed to stock fish in the State of Indiana, do I need to get a permit from the State to stock fish in a pond owned by a city, even if the city contacts me to stock the fish, and the city pays for the fish? Or does the city need to get the permit, or is no permit required?

I have posted the Indiana Administrative Code below that pertains to fish stocking. The administrative rule places the burden on the person stocking the fish to ensure a permit is obtained. However, it does not designate whether the person doing the stocking or the owner of the pond is required to obtain the permit. I would state, according to the IAC, it does not matter if you obtain the permit or if the city obtains the permit.
312 IAC 9-10-8 Fish stocking permits

Sec. 8. (a) A person must not stock fish unless a permit is obtained from the division under this section.
(b) An application for a fish stocking permit shall include the following information:
(1) The species and number of fish to be stocked.
(2) The location of the waters to be stocked.
(3) The reasons for the stocking.
(4) The date of the proposed stocking.
(5) The source of the fish to be stocked.
