I stated where I stood in the post above and to answer your question, I don't feel like the crime you commited warrants loss of your rights. On the other hand, this wasn't this guys first "mistake". I think they should confiscate his weapons, vehicle, slap him with fines and jail time.

I got one to throw in the mix for ya !!!! I WAS CONVICTED OF A FELONY ABOUT 10 YRS AGO, for a non violent crime which w/o gettin into too many details, I met a woman in a bar (yes in a bar) later after havin a relationship w/ her for months found out she was in fact 16 yrs old. I was charged w/ statueitory rape, which was later changed to battery w/ intent a class d felony. I LOST MY 2nd Amendment rights for for than 8 yrs !!!! SINCE THEN I HAVE HAD MY CONVICTIONS OVERTURNED IN SUPERIOR COURT TO MISDEMEANERS, AND CAN FINALLY OWN A FIREARM AGAIN> YET I CAN NOT HAVE A CONCEALED CARRY PERMIT> SO ALL OF U THAT THINK THE GUY SHOULD LOSE HIS GUNS TELL ME THIS DO U ALSO THINK THAT I SHOULD OF LOST MINE ? AND WHAT DO U THINK ABOUT THE FACT I STILL CANNOT CARRY A CONCEALED WEAPON> I AM NOT A VIOLENT PERSON OR HABITUAL CRIMINAL YET BECUZ I WAS LABELED A FELON I LOST MY AMENDMENT RIGHTS ! Our government system is screwed up enough IMO and we shouldnt just throw away the key on everyone that made a mistake, I had no prior record for any crime and have never been in trouble w/ the law since that date, not even a speeding ticket, yet ppl assume that I am a criminal and a violent person becuz at one time when I was 21 yrs old I made a mistake which could of been avoided if I wouldnt have been lied to in the first place and the Bar I attended that night would have carded its patrons ! SO U TELL ME WHAT U THINK ABOUT PPL LOSING THEIR AMENDMENTS RIGHTS< CUZ IMO NO ONE SHOULD LOSE THEM UNLESS THEY COMMITTED A VIOLENT CRIME AND USED A FIREARM IN THAT CRIME ! TO THROW EVER SINGLE PERSON THAT MAKES A MISTAKE IN JAIL OR TAKE THEIR RIGHTS AWAY DOES NOTHIN FOR THE PPL THAT ACTUALLY CHANGE THEIR LIFE> CRIMINALS THAT CONTINUIOUSLY DO ILLEGAL THINGS SHOULD BE PUNISHED BUT THOSE THAT CHANGE ANG REHABILITATE THEMSELVES TO BECOME LAW ABIDING CITIZENS SHOULD NOT HAVE TO SUFFER FOR THE REST OF THEIR LIVES FOR MISTAKES THEY MAY HAVE ONCE MADE !!! THose ppl that are lifetime criminals dont care about gun laws or amendment rights they will still get their hands on firearms and the guy that killed 34 deer whether he loses his gun privleges and hunting privleges will still (more than likely) poach animals and have a firearm. I have fought for yrs in the court system to change my convictions into misdemeaners and have been pursuein expungement of those same convictions. I take full responsibility for sleepin w/ the underage girl now becuz I didnt take the time to get to know more about her b4 I had intimate relations w/ her, but even with that said it would have never happened if she hadnt lied to me and been in that bar, I served months in jail, had 200 hours of community service, had a yr and a half probation,paid numerous fines and court costs, spent 26 weeeks in a counseling enviroment for it, and lost not one but two amendment rights. I not only lost the right to bear arms but lost my 4th amendment right. THe police can come to my home at any time w/ no reason at all and search my premises, all becuz I was labeled a FELON !!!! SO WHAT DO U THINK IS IT RIGHT OR WRONG ? IM CURIOUS TO KNOW EXACTLY HOW SOME OF U THINK ABOUT THE WHOLE MATTER. dont hold back either u wont upset me no matter what ur opinion but I do want to know it lmao All Felonies are not equal and should not be treated the same. Non violent felons should have a reliable consistent way to regain their 2nd Amendment rights. Thank you for the story and I would like to tell you to keep moving forward with your life and best of luck.

I have somewhat a weird question for u all though, lol, becuz I was a felon I couldnt own a firearm; hand gun, shotgun, rifle etc. but I was told that I could posess a compound bow recurve or crossbow. That got me thru hunting season and prolly the only thing that kept me sane for those yrs I couldnt gun hunt. HERE IS THE QUESTION I WAS TOLD BY THE STATE THAT EVEN THOUGH I WAS A FELON AND COULD NOT OWN A FIIREARM I COULD LEGALLY OWN AND HUNT WITH A MUZZLE LOADER OR MUZZLELOADER HAND GUN BECUZ THEY ARE NOT CONSIDERED TO BE FIREARMS> NOW U TELL ME DONT U THINK IF I WAS A TRUE CRIMINAL THAT I WOULDNT BE ABLE TO USE A MUZZLEOADER TO ROB A BANK OR A STORE ? HECK I COULD GO ON A RAMPAGE AND SHOOT PPL FROM MORE THAN 150 YRDS SET UP IN A BUILDING OR SOMETHING MIGHT TAKE A LIL LONGER TO LOAD BUT IT COULD BE DONE> dont get me wrong I loved the fact I could still hold on to my inline and hunt with it during firearms season but it doesnt exactly make sense to me why those arent considered to be a dangerous weapon. Thats the real reason I could own one, a felon cant own dangerous or deadly weapons, which with all my experince the bow and arrow and the muzzleloader are just as deadly of a weapon(s) as a shotgun, imo a muzzleloader is more accurate at longer distances than a shotgun is. I just had to pass that lil piece of info on to u guys. So even if the guy that killed those 34 deer would happen to get his 2nd amendment rights taken away he will still be able to own a bow and a muzzleloader so its not like he wont be able to still poach lmao, I just dont get our government sometimes !

The M/L can't be an inline as they can be converted to fire shotgun primers which is not allowed. Therefore (unless they changed the laws) a Felon can ONLY use a side hammer M/L with regular primer caps. 2. Convicted felons can't use any of the smokless powders & must use Black Powder. 3. Convicted felons can't use saboted bullets only round patched balls. I agree with you on the Government's lack of knowledge regarding Muzzle Loaders as NOT being weapons (?) To me a firearm (ANY) has the capability to firing a projectile or bullet by any means regardless of what is used to make it fire. Therefore M/L's are just as dangerous as modern firearms, eventhough it can be fired only one shot at a time. Again, correcet me if I am wrong, but IMHO all these "Feel Good" laws are worthless and if a Criminal wants a modern gun bad enough; he only has to shop the local paper ads to find a person seeking to sell his/her gun. The Felon can then buy it without going through a background check or filling out that silly form which the Government never looks at.

I sgree withu there on the felon searchin the papers and I am not positive on the m/l laws exact regulations, the only thing I was told is that I could hunt with me in-line m/l even though I was a convicted felon and I honestly did not check into the regulations I just went on what the state trooper told me at that time. Which is prolly a mistake on my part ! Luckily I didnt get in trouble if u are correct becuz I used sabots and an inline m/l. Like I said I went soley on the fact the state trooper and my probation officer at the time tellin me that I in fact could use my in ine m/l and the probation officer handed me a print out stating that fact but it didnt go into any more detail into what I culd or could not use as projectiles or propellents.

buckbuster, I would reply to your last post, however I am afraid to because I was BANNED from the Kentucky Hunting Forum for expressing my views on this "Poaching" thread. Sorry & please understand. Why I was banned over there I can't understand other than I was simply wasn't liked by a few & the moderators. I am going to miss, being able to participate in the Ky. Hunting Forum. The ban, I was told, was forever.

Telling a criminal they can't own a firearm is like telling an alcoholic they can't have another drink IMO. Too many ways to get one if they want one. The only people it affects are the people who make a mistake and try to put themselves back on the right track. Does that prevent them from getting in more trouble? I doubt it. It's a feel good law that sounds like it protects the masses from criminals. But if a criminal is OK with breaking laws multiple times what makes anyone think they will change?
The rules just restrict the honest.

The moderators are very rude and some of the members try their best to discredit anything one says concening the issue or topic at hand. There is a lot of taunting of members over there and it has become worse. I was banned because I believe I am not liked. When I moved to Ky. I just wanted to make a few forum friends inorder to exchange ideas and talk about our favorite sport of hunting & shooting down here. All I've received is being called a "Gun Grabber", Liberal, & Obama supporter, which is all untrue. I was labeled with these names because I thought that Poacher should not be allowed to own a gun because of his past & present poaching of game animals. I was just trying to protect the image of sport hunting & gunowners. Those, who don't hunt or own guns read articles dealing with poaching like this one, and then "label" all Hunters & Gunowners as Criminals. But they failed to understand what I was saying.

Damit man, don't fret about being banned over there. The mods over there all have their favorite ponies and let them say what they want, if you rebut, then you get the boot. Heck, I've been banned from there fo life twice and now they just banned my son because he's my son. You can get banned there without breaking any rules what so ever. poor show. For reasons I'll never understand, being that the site is owned by a large retailer of hunting ites, they allow mostly anti-Kentucky Dept. of Fish and Wildlife postings. The main mod doesn't like the Dept. and allows his cronies unlimited say so on bassing the game agency. Rules there don't mean squat.

Thanks, Tom. I remember you being on that Ky Forum and always enjoy reading your post & great suggestions. It sounds like they banned me, just like in your case. They pick someone then go from there & they have picked on me for sometime now, and I don't know why. The moderators over there are the absolute WORSE. They just don't care and they should be replaced. The fellow named "Keith Meador" or whatever is name is was very rude to me and he is the one who banned me. The Ky Hunting site is owned by Uncle Lee's located in Greenville, Ky. and I think it would help if everyone would contact them and let them know what is going on. <I am sorry you & your Son were banned, Tom >

No wonder they thought you was a gun grabbing Obama loving liberal. ;D

At what point do u all think that a misdemeaner poaching charge should turn into a felony poaching charge, or do u think that one can commit enough poaching to be considered a felony. I know a battery charge in Indiana is a misdemeaner unless it can be proven u had intent to harm which then is a felony charge. Same as if a person commits enough crimes they are considered a habitual offender. IMO shouldnt there be a law for habitual poachers. Ppl make mistakes (I have made my share) but at what point do u quit giving a person chances ? The poacher we all started talkin about in this thread has been convicted of poachin before and now is charged with takin 34 deer and 2 turkeys so at what point or any point do u feel like the man should be considered a "habitual offender" or be charged w/ felony poaching ? IMO I think if u are charged w/ poachin and u serve ur time or pay ur fines whatever u have to do and change then u shouldnt have any lastin effects from it but if a person consistently poaches has been convicted of it b4 and takes a large numner of deer or turkeys (any game for that matter) at some point they should be considered a felon or habitual offender and possibly face the loss of their firearm privleges. When the state or federal government has agreed that certain crimes such as felonies, violent crimes, or gun crimes result in loss of 2nd amendment rights then I think habitual poaching should also be considered as the same. I dont like the fact any one can lose their amendment rights period but since there are crimes u can be convicted of that result in that loss then poachin should also be considered one of those crimes ! SORRY TO HEAR ABOUT U BEING BAN DRS< GUESS THAT JUST LEAVES U MORE TIME TO BE WITH US HERE !

Statin that IMO poaching should be considered for loss of amendment rights I dont mean for every case, I am referrin to: IF a person has been convicted several times the person poaches from out of state (like in the guys from Florida poachin in IN.) A vast number of animals has been poached etc. and should be looked at by case by case. HOPEFULLY MY THOUGHTS ON THIS WONT GET ME BANNED< I THINK WE ARE ALL ENTITLED TO AN OPININON AND FREE SPEECH which is also an amendment right lol
