One other thing that might help is placing an old stand that is very visual from the main access point, if people know others are hunting that may also serve as a deterant. It helped on our farm, I placed an old wooden ladder stand on the front edge of the woods, in sight of the road, and haven't had to have words with trespassers since.

if they are caught. act like a compleat Idiot ,Scream, cuss,kick things, jump up and down spit and foam at the mouth most understand those actions and pass the word along about THE CRAZY ONE. it works ;D NO! Here's a better way to deal with those who Trespass on your land. FIRST: (if a treestand is already in place) get a heavy chain & two locks and lock the Trespasser's stand to the tree. SECOND: Leave a note stating that if he wants the treestand back he needs to contact you (landowner) to retrieve his stand & face the consequences of Trespassing. This is what I'd do if I found a stand on my property.

I got a call from the C.O. today that was responding to my e-mail that I sent them on Thursday. He's stopping by the house tomorrow. He said that they have a form to fill out that says you're willing to prosecute, other information like a property description, etc. He said it makes it easier for them to get to the property if a trespass is called in.
I'll post more tomorrow after I meet with him.

It seems to me that you only borrow the land anyway you never really own it. If you fail to pay the property taxes they take it, you ever hear of a little thing called "Right of Eminent Domain" they take it if they want it from you, You die someone inherits it but a damn lawyer eats up most of the inheritance,etc, etc,.... truly in the end you really own nothing you are only borrowing it til someone else takes it, you die, or you can not afford it anymore !!! So i say share the wealth , Tax the Hell out of the rich, and let people enjoy the land because you didn't make the land and you certainly have no right to tell someone else how to enjoy the ample bounty that God has provided for us through nature the system is getting better and it is making all men more equal all the time so the rich , greedy, private mindset is going by the wayside like the Titanic, get used to it . Your signature line suggests that you do not trust the Government, yet this post sounds like you are on the Obama, Pelosi, Reed campaign committee. I simply don't understand. This Country was founded on the principle that every man was created equal- meaning that every man (and woman) has the same equal opportunity to make what ever they dream out of there life, not that we all get an equal share of the "pie". For that to happen, one entity has to have the "pie". The pie in this Country is the opportunity and not the reward. If you truly want an share of any "pie" than I would suggest relocating to a Country that lives by that mentality and not crying for this one to change to your thinking just because you don't feel you are getting everything someone else has. There are inequalities abound in this Country, trying to deny that is just lying to yourself. The difference is, here you at least have the opportunity to change your circumstances. Sorry everybody for the rant, didn't mean to get so far off the thread topic.

Deerslayr, if you truly feel that way why don't you open up your back yard to the homeless for a tent camp, if you own it, that should be available to everyone to use also, if you truly believe what you posted.

Deerslayer, just wait until you have something that somebody else wants. You'll change your tune. That's the problem with a lot of people that I run across that don't have the drive to do things for themselves, they expect to get a lot of handouts.
I had a lot of other stuff typed, but I can see that it's no use so I deleted it.

LOL Come on people geesh i have a" No Trespassing" sign at the end of our lane. I just think people need a wake up call every once in a while to see how much their heart is where their words and deeds are... Word's come cheaply actions require payment! You're contradicting yourself. According to your prior post, all actions should be free.

The CO swung by the house today and gave me a form for the landowner to fill out. The CO said they only have jurisdiction over hunting/fishing/trapping violations. Trespass violations are governed by the sheriff. The CO basically said they give a warning for the first infraction, then anything after that is in enforceable fine.
So, it's off to do as much paperwork I can do for the landowner, then have him go over it, sign it and send it in. I'll be stopping at the Knox Sheriff Dept (i.e jail) tomorrow and see how it works on their end.

If they have guns or bows with them while they are trespassing, then the other violations add up. Basically it give the CO something to arest them on and the trespass charges are added by the county when they are taken in.

Nope but would shoot Bigfoot to stuff him and make a ton of money off of it so I could buy more land and post it... The CO's in my area I know were giving out tresspassing charges a couple years ago because they busted my cousin for it. Then they came and checked me but I wasn't hunting on the mines land like he was and I had permission to be there. The mine wanted to get all hunters out of the woods and had the CO's writing tickets and giving people court dates or something like that. My cousin called me that night because he saw them stopping me after they had stopped him. And he was mad when I didn't get a ticket but I told him I wasn't hunting on the mines property. So he settled down. But I thought they could give out tresspassing tickets. But I might be wrong I guess. Good to know. I'll have to put the County boy's on my phone list. BB

Well, I talked to the sheriff today and came away with less than a warm and fuzzy feeling.
He said that they don't arrest trespassers on the 1st, 2nd or even 3rd time. They ask them to leave, check their identification and if they willing leave and have no outstanding warrants, let them go.
What the landowner has to do is after they are caught the first time is fill out a restraining order on them. THEN if they are caught a 2nd time they can be prosecuted.
What really got me is this: (The sheriff said that I need to check with a CO to verify it tho) If the trespasser puts up a tree stand, the landowner cannot take it down and keep it. Even if he were to take it down and put it outside his garage by the road it's a no-no. The trespasser could press charges for misdemeanor theft against the landowner.
It sounds like the laws are slanted for the criminals.
I will be calling the district office tomorrow and getting a clarification on the tree stand issue.

Ah remember though in a hunting situation the trespasser will most likely be armed with a weapon also and just might shoot back..... My answer would be: Officer, I was in fear of my life. I'd like to talk to my attorney. I don't plan on confronting anyone. Just take their picture, and call the appropriate agency. If they leave the property, follow them and either get a license plate number or see where they go.
