Firstwd So what would that fine/ticket be if they haven't shot a Deer? Just a warning at best? Actually, you don't have to shoot a deer to be hunting a deer. That would all depend on what the officer sees or the offender is dumb enough to admit. Just looking through a scope at a deer or firing a missing shot would qualify as active hunting if an officer sees it. There used to be a family that lived next door to me that would deer hunt with HPR's every year, along with a friend or two of theirs. I actually ran into one of them and his friend in the woods once and back in the late 90's and they were both packing them then and even told me that they'd almost had a shot but the landowner had come driving back on the farm and spooked it. That guy and his brother were actually caught packing HPR's during deer season a few years later and cited, even though they had not made a kill. The same for another in-law of theirs. He was caught coming out of a paper company's property (trespassing) with a .30-06 and cited as well. So, obviously they can bust you even without a dead deer.

I believe these are the applicable violations and penalties for hunting with a PCR on public:
IC 14-22-38-1 Violations generally Sec. 1. (a) Except as otherwise provided in this article and subject to subsection (b), a person who violates this article commits a Class C infraction. (b) Except as otherwise provided in this article, a person who knowingly or intentionally violates this article commits a Class C misdemeanor. (c) A person may not be charged with both: (1) a Class C misdemeanor; and (2) a Class C infraction; under this section for the same act or omission.
IC 34-28-5-4 (c) Except as provided in subsection (f), a judgment of up to five hundred dollars ($500) may be entered for a violation constituting a Class C infraction.
IC 35-50-3-4Class C misdemeanor Sec. 4. A person who commits a Class C misdemeanor shall be imprisoned for a fixed term of not more than sixty (60) days; in addition, he may be fined not more than five hundred dollars ($500). As added by Acts 1978, P.L.2, SEC.3554.

The latest .... “Latest word is that rifles are still not legal for deer hunting on public property, however, there are people working to fix this. Please monitor the DNR/DFW webpage for any changes.” So everyone please watch for any changes so we can get the word out quickly IF it happens.. It should show up here... www.in.gov/dnr/4934.htm

As of yesterday, it is my understanding the Governor is going to fix this via some type of Rule or executive order. There is nothing official yet, but I expect something very soon. It is my hope that these other steps you suggest will not be necessary.

I hope these latest statements by the state are true and there really is a fix in the works.
Something tells me the gov would say it regardless. Instead of letting us move on and do what we have to do for this year, they would just be making it more last minute for those having hope and listening to them.

Just called my representative for the 5th time. This time they directed me to the governors office. They said if a fix was going to happen it would have to come from the governor. So I called them and got directed to Shelley Reeves, the governor's liaison for the DNR. She actually sounded a little frustrated. Apparently they've been getting quite a few calls. She said they are trying to do something but the earliest they'd know anything would be early next week. So I guess we wait.
But if you want to make a little noise in the mean time, call 317-232-4567 and ask for the Shelley.

Here's my thoughts. Seeings how we are talking about government here. There will be an executive order. This one will allow all hpr's on public land..... And make them illegal on private land.

IC 14-22-2-8Deer hunting; permitted firearms; required report Sec. 8. (a) This section applies to a hunting season beginning after June 30, 2016, and ending before January 1, 2020. (b) A hunter may use a rifle during the firearms season to hunt deer subject to the following: (1) The use of a rifle is permitted only on privately owned land.(2) The rifle must have a barrel length of at least sixteen (16) inches. (3) The rifle must be chambered for a cartridge that fires a bullet that is two hundred forty-three thousandths (.243) of an inch in diameter or larger. (4) The rifle must fire a cartridge that has a minimum case length of one and sixteen-hundredths (1.16) inches, but is no longer than three (3) inches. (5) A hunter may not possess more than ten (10) cartridges for the rifle while hunting deer under this section.(6) The rifle must meet any other requirements established by the department. (c) The use of a full metal jacketed bullet to hunt deer is unlawful. (d) The department shall report on the impact of the use of rifles to hunt deer under this section to the governor and, in an electronic format under IC 5-14-6, the general assembly before February 15, 2020. (e) This section expires June 30, 2020. As added by P.L.110-2016, SEC.1. Amended by P.L.195-2017, SEC.7. Yes. Subsection "b" specifies hunt, not kill. How about that. They got the language clear about the cartridge limit being exclusive to this section, but not where to legally use the weapon!

Actually it's wrong about the cartridge limit too,it use to be for the HPRs only and now it's for the PCRs too.
